How does cmte accomplish its purpose?*The National Advisory Committee (NAC) produced one advice letter with numerous recommendations to EPA on a variety of North American environment and trade policy issues related to the Commission for Environmental Cooperation (CEC). The committee held one meeting in fiscal year 2020. All meetings include public comment sessions and presentations by high ranking officials in the United States Government, senior officials from the CEC Secretariat in Montreal, Canada, and the Chair of the trilateral Joint Public Advisory Committee. This blend of experts and high-ranking officials at meetings engages members in a rigorous dialogue from which to create their advice. During the April 2020 virtual meeting, the NAC met jointly with their sister committee, the Governmental Advisory Committee, for the first two hours and then separately on the last hour to develop distinct advice letters commensurate with their sector groupings. In addition, the NAC Chair provided a summary of the committee’s advice letter at the CEC 2020 virtual Council Session chaired by the Canadian Environmental Minister. The main accomplishments of the Committee are summarized below:

The committee’s April 27, 2020 advice letter contains recommendations on the five strategic priorities in the CEC’s draft Strategic Plan: 1) Circular Economy and Resource Efficiency, 2) Clean Air, Land and Water 3) Shared Ecosystems and Species, 4) Shared Ecosystems and Species, Resilient Communities and 5) Effective Enforcement of Environmental Laws.

The U.S. Government (USG) replied to the NAC with a letter on July 29, 2020 addressing their recommendations. First, it “thanked the NAC for their ranking exercise within each strategic priority area and cross-cutting approach as it will inform our decisions…also appreciated recommendations regarding specific project/initiatives…” Regarding priority #1, the USG concurred with NAC’s advice that “that cooperation regarding information exchange (best practices, data and scientific information) will be an integral part of implementing work under this priority.” The U.S. also reiterated that “projects addressing issues in the Strategic Plan will be specified and described in Operational Plan.” Regarding priority #2, U.S. replied that it agrees that “considering health standards should continue to be a component of our decision-making process.” Regarding priority #3, the USG agreed that we should aim to undertake actions that focus on high-impact change with a common understanding on the needs.” Regarding issues involving the Tijuana River Valley, the USG said, “EPA will be addressing the transboundary water flow issues and sewage pollution infrastructure needs through our US-Mexico binational efforts.” Regarding priority #4, the USG thanked the committee for “identifying the issues that are of highest priority to the NAC… and appreciated the committee’s feedback regarding the inclusion of extreme weather events within the existing priorities identified.” Regarding priority #5, the USG stated that the Parties will not be ranking the issues of interest within the Strategic Plan but will make those determinations when developing Operational Plans.” Finally, the USG thanked the NAC for “its comprehensive and helpful advice in response to the development of the 2021-2025 CEC Strategic Plan.”
How is membership balanced?*As called for in its authorizations, the NAC consists of representatives from environmental groups, business and industry, academia and other non-governmental organizations.
How frequent & relevant are cmte mtgs?*The NAC typically meets twice a year to discuss North American environmental issues. The Fall meeting is to discuss the CEC's Draft Operational Plan. The Spring meeting is to advise the EPA Administrator on deliverables for the annual summer Environmental Ministers meeting. In FY 2020, the NAC once.
Why advice can't be obtained elsewhere?*The NAC is authorized under Article 17 of the North American Agreement on Environmental Cooperation and the North American Free Trade Implementation Act, P.L. 103-182, and is directed by Executive Order 12915. The NAC is currently operating under the authority given in Executive Order 13811, dated September 29, 2019.

The agency responds with a letter informing the NAC of the status of their advice i.e., whether they have implemented their recommendations or whether the EPA has decided on an alternative direction.Narrative Description*The National Advisory Committee (NAC) supports the agency’s mission of protecting human health and the environment. The work of the GAC supports the EPA Administrator in achieving the goals of safeguarding the natural environment--air, water, and land, via trilateral activities in the Commission for Environmental Cooperation (CEC). The CEC is a trilateral institution created by the North American Agreement on Environmental Cooperation (NAAEC) and funded by the Governments of the United States, Mexico, and Canada.

The NAC provides the EPA Administrator with policy perspectives from academia, industry and non-governmental representatives. Their advice is useful to the U.S. Government as it negotiates the cooperative 5-Year Strategic Plan, and the Operational Plan with Canada and Mexico and prepares for the outcomes of the annual Environment Ministers Council Session. Each year the committee reviews and provides advice on two major CEC products. One is the Operational Plan and secondly is the CEC’s Annual Council Session and other topics as directed by the EPA Administrator. Every five years the Strategic plan is also reviewed by the GAC. The Operational Plan addresses key issues in the CEC Strategic Plan, which sets tri-lateral priorities for environmental management in North America. The current five priority areas in the CEC Strategic plan are: 1) Circular Economy and Resource Efficiency, 2) Clean Air, Land and Water 3) Shared Ecosystems and Species, 4) Shared Ecosystems and Species, Resilient Communities and 5) Effective Enforcement of Environmental Laws.

In fiscal year 2020, the NAC completed one advice letter and 5 recommendations to EPA on a variety of North American environment and trade policy issues related to the CEC. The committee met once in fiscal year 2020. In addition, the NAC Chair provided a summary of the committee’s advice letter at the CEC 2020 virtual Council Session chaired by the Canadian Environmental Minister.
