How does cmte accomplish its purpose?*The Commission, pursuant to the National Defense Authorization Act for Fiscal Year 2006 (Public Law 109-163) and Section 1072 of Public Law 109-452, shall provide the Secretary of Defense independent advice and recommendations on matters pertaining to the achievement of the goals set forth in the report of the Secretary of Defense submitted to Congress on December 31, 2001, providing the results of the Nuclear Posture Review conducted pursuant to section 1041 of the Floyd D. Spence National Defense Authorization Act for Fiscal year 2001, as enacted into law by Public Law 106-398; 114 Stat. 1654, 1654A-262, and results of periodic assessments of the Nuclear Posture Review.
How is membership balanced?*The Commission shall be composed of not more than twelve members from among private U.S. citizens with knowledge and expertise in the political, military, operational and technical aspects of nuclear strategy. Commission Members shall be appointed by the Secretary of Defense in consultation with the chairman and ranking minority member of the Committee on Armed Services of the Senate and the chairman and ranking minority member of the Committee on Armed Services of the House of Representatives.
How frequent & relevant are cmte mtgs?*The committee never meet; funding was denied and later Congress terminated the committee.
Why advice can't be obtained elsewhere?*The Commission was directed by the National Defense Authorization Act for Fiscal Year 2006 (Public Law 109-163) and Section 1072 of Public Law 109-452.
Why close or partially close meetings?Meetings are not closed to the public unless the Department of Defense determines that items on the planned agenda meet the closed meeting provisions of 5 U.S.C. § 552b(c). Pursuant to DoD policy closed meetings can only be authorized by the DoD Sponsor (e.g., the Under Secretary of Defense for Policy), and only after consultation with the Office of the Department of Defense General Counsel.
Recommendation RemarksSection 1071 of Public Law 110-181 terminated this committee. The committee was never populated nor were any public funds spent on the committee. Since the committee was not populated there were no meetings or reports issued by the committee.
